Terms of Service

These Terms of Service govern access to and use of datamarketer.com, including audits, accounts and subscriptions. The operator is the administrator of the datamarketer.com service. In these terms, we, us and our refer to that administrator. You and customer refer to the business using the service and its authorized users as applicable.

Accepting these terms for your business

By accepting these terms when creating an account or using the service, you agree to them on behalf of the business you represent. You must have authority to bind that business and authorize its users. If you lack that authority or do not agree, do not create an account or use the service.

These terms apply with the plan details presented when you subscribe and any separate written agreement accepted by both parties. If a data processing agreement conflicts with these terms on personal data processing, that agreement controls for that subject. The Privacy Policy explains information handling and your privacy rights.

What the service provides

DataMarketer provides marketing tracking audits, read-only connected analysis, attribution, reporting, monitoring and AI analyst answers within the selected plan. Plan features and limits determine the available sites, connected ad accounts, seats, history and analysis capabilities. Findings support your team's assessment of measurement and performance rather than transferring campaign control to the service.

Review the marketing analytics tools for capabilities and the marketing analytics platform page for current plan limits. Third-party accounts, permissions, consent settings and data availability affect the analysis the service can provide. Features that depend on connected sources require an authorized connection and relevant source data.

Maintaining an authorized account

Provide accurate account information and keep your account email accessible so you can receive verification, billing and service notices. Protect passwords and verification codes, and notify support if you suspect unauthorized access. Your business is responsible for its users, their account activity and the permissions it grants within the service.

Use only accounts and data sources you are authorized to access. Do not share a login to avoid seat limits or misrepresent your identity or authority. Keep access aligned with job responsibilities and remove access when it is no longer needed. We may request reasonable information to verify account control or investigate a security concern.

Monthly and yearly billing

Subscriptions are available monthly and yearly in USD. Monthly plans are billed for each monthly period, and yearly plans are billed in advance for each yearly period. Your subscription automatically renews for the same billing period until canceled. The plan, billing frequency and amount are disclosed before you commit to a paid subscription.

Starter costs 49 USD per month or 288 USD per year. Growth costs 149 USD per month or 888 USD per year. Scale costs 499 USD per month or 2 988 USD per year. The yearly monthly equivalents are 24 USD, 74 USD and 249 USD respectively. Review your chosen frequency and billed total before confirming.

You authorize recurring charges for the selected plan and applicable taxes until cancellation. Prices exclude taxes unless expressly stated otherwise. You are responsible for applicable taxes other than taxes on the operator's own income. Payment providers may apply their own currency conversion or account fees. Keep payment and billing information current.

If payment fails, we may request an updated payment method and suspend paid access after notice and an opportunity to resolve the failure where appropriate. A billing dispute does not authorize misuse of the service. Email [email protected] with the account email and the charge in question.

Managing renewals and subscription changes

You can cancel a monthly or yearly subscription at any time to stop its next renewal. Access continues until the end of the paid period. You can switch plans with proration for the remaining period, with the adjustment disclosed before confirmation. Review the receiving plan's limits before reducing sites, seats or connected accounts.

Cancellation does not itself create a refund for a paid period. Refunds remain available where required by law, agreed in writing or appropriate to correct a billing error. If you request immediate deletion, it can remove the data needed to continue using your remaining access. Contact support if you need help canceling or understanding an adjustment.

We give notice of subscription price changes before they take effect at a renewal, allowing you to cancel before the changed charge applies. We do not increase the price of an already paid period retroactively. Yearly Scale includes SSO (SAML), custom retention, invoicing and security review documents. Create your account, then email [email protected] for invoicing. No sales call is required.

Auditing only authorized websites

The free one-time audit is a separate inspection of public website pages, not an ongoing subscription. Submit only a site you own or are authorized to test. By submitting a URL, you confirm that authority and permit the service to fetch public HTML and inspect visible tracking and consent signals for the requested audit.

The audit can identify visible tags, duplicated identifiers, consent setup issues and measurement gaps on inspected pages. It cannot establish that every visitor event reaches every destination or that a site complies with all legal requirements. Results depend on accessible pages, site responses and the information you provide. Do not submit private resources, unauthorized targets or URLs containing confidential credentials.

The first 3 signals are readable immediately. Creating an account and verifying your email unlocks the full audit. No card is required. Audit results are retained for 30 days. The service may limit audit usage to protect availability and prevent abuse. Read about the ga4 audit before submitting a site.

Using the service responsibly

Use the service for lawful business analysis within the access rights you hold and the limits of your plan. Do not interfere with security or availability, access another customer's data or submit content that infringes rights. Your permissions to connect data must cover the processing required to provide the requested service.

  • Do not attempt unauthorized access, credential theft or exploitation of another customer's account.
  • Do not upload malicious code, unlawfully obtained records or information you lack permission to process.
  • Do not bypass usage limits, access controls, verification or billing requirements.
  • Do not disrupt the service or use audits to probe systems without authorization.
  • Do not use service communications for harassment, fraud or unlawful activity.
  • Do not resell account access or remove proprietary notices without authorization.

Agency use for authorized clients and the reporting features included in a plan are permitted. Report suspected security issues to [email protected] using the responsible disclosure guidance on the marketing data security page.

Your data remains yours

You retain ownership and rights in the data you submit or authorize the service to read. You grant us a limited permission to access, process, store and display that data only as needed to provide the service, maintain security and comply with applicable law. This permission does not transfer ownership of your data.

Connected access is read-only. DataMarketer never changes campaigns, budgets, bids or settings in connected platforms. You control whether to apply a recommendation. You are responsible for lawful collection, required notices and consents, account authorization and the accuracy of data you submit. Third-party platform terms continue to apply to your use of those platforms.

We do not sell personal information or share it for cross-context behavioral advertising. Processing by service providers remains subject to appropriate obligations. A data processing agreement is available on request at [email protected]. Protect downloaded reports and exports according to your own data handling requirements.

Reviewing analysis before acting

AI analyst answers, attribution results, forecasts and budget scenarios can be inaccurate, incomplete or affected by missing data. They are decision support and do not replace your judgment or independent verification. You remain responsible for campaign changes, budget decisions, client advice and any action taken using an answer or report.

Check important conclusions against source data and review the assumptions behind attribution or modeling. The service does not guarantee that a proposed action will improve performance, recover spend or produce revenue. The ai data analyst page explains how answers present the numbers behind an analysis. Do not treat an answer as legal, tax or regulated professional advice.

Service availability and measurement limits

We work to maintain service availability, but access can be interrupted by maintenance, faults, security events or third-party outages. Connected platforms can change permissions, interfaces or data availability. We do not guarantee uninterrupted access, error-free analysis, complete source coverage or particular financial results. Any separately agreed availability commitments apply only as expressly written.

We may adjust features to maintain security, reliability or compatibility. If a material reduction affects a paid subscription, we provide notice where practicable and an appropriate remedy as required by law or a separate agreement. Customers should maintain their own source records and copies of reports needed for business or legal purposes.

Rights in the service and reports

We and our licensors retain rights in the service software, interface, documentation and branding. Subject to these terms and your subscription, you receive permission to use the service for your business during your access period. This permission does not grant ownership of the service or authorize copying, distributing or reverse engineering it except where law permits.

You may use and share reports produced from your own authorized data for your business and client work, subject to the plan features and third-party rights. White-label features apply where included in your plan. You remain responsible for the data and interpretations you distribute. Nothing in this section limits your ownership of customer data.

Ending access and handling remaining data

We may suspend access when necessary to address a material breach, unpaid fees, unlawful use or a security risk. Where reasonable, we give notice and an opportunity to resolve the issue before suspension or termination. Immediate action may be necessary to protect customers or comply with law. Any action is limited to the circumstances requiring it.

You may end renewal through cancellation and request deletion by contacting support. At the end of the paid period after cancellation, paid access stops and account and connected data are deleted, subject to necessary legal retention. A deletion request may end access earlier. Analysis history otherwise follows plan limits and any agreed custom retention arrangement.

If we discontinue your paid subscription for convenience rather than your breach, we refund unused prepaid subscription amounts attributable to the remaining paid period. Termination does not remove accrued payment obligations or rights and duties that by their nature continue, including confidentiality, ownership, liability limits and dispute provisions. Statutory rights remain unaffected.

Service warranty disclaimer

To the extent permitted by applicable law, the service is provided as is and as available. We disclaim implied warranties of merchantability, fitness for a particular purpose and noninfringement. We do not warrant that every tracking issue will be detected or that the service will satisfy every business, regulatory or technical requirement.

The customer must assess whether the service meets its needs and verify analysis before taking action. Nothing in these terms excludes a warranty, remedy or obligation that cannot lawfully be excluded. Any express commitment in a separately accepted written agreement remains subject to the terms of that agreement.

Limits on recoverable losses

To the extent permitted by law, neither party is liable under these terms for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue, business opportunities or goodwill arising from service use. This exclusion applies regardless of the claim's legal basis, but only where applicable law allows it in the circumstances.

To the extent permitted by law, our total liability for claims arising from the service is limited to the subscription fees you actually paid for the paid subscription period in which the event giving rise to the claim occurred. This limitation does not create a right to exclude liability that applicable law makes nonexcludable.

The exclusions and cap do not apply to fraud, willful misconduct, gross negligence or other liability that cannot lawfully be limited. They do not restrict mandatory privacy rights or required remedies. For use without a paid subscription, liability is limited only to the extent permitted by applicable law, with the same exceptions.

Applicable law and resolving concerns

The governing law and competent courts are determined under the applicable conflict of laws and jurisdiction rules. These terms do not select a particular state or country or remove protections that mandatory law gives either party. No provision requires a dispute to be heard where applicable law does not permit it.

Before starting a formal dispute, contact [email protected] with the account details, the issue and the remedy requested so we can try to resolve it. This does not prevent either party from seeking urgent legal relief or exercising rights within a required deadline. Any mandatory dispute process under applicable law remains available.

Notice of material changes

We may revise these terms to reflect changes in the service or legal requirements. We update the date on this page and provide notice of material changes through the service or account email before they take effect where required. If renewed acceptance is legally required, we obtain it before applying those changes.

Changes do not retroactively alter an already paid billing period or remove rights that cannot be waived. If you do not accept a material change, stop using the service and cancel renewal before the change applies. Any right to a refund or other remedy under applicable law remains available.

Questions about these terms

Email [email protected] for questions about these terms, billing, account access or deletion. The operator is the administrator of the datamarketer.com service. Include your account email if applicable and describe the issue. Do not include passwords, verification codes or connection tokens when asking for help or discussing a disputed charge.

The marketing data analysis answers explain common product and billing questions. If a provision of these terms is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a right does not waive that right.

Start with an authorized site audit

Before connecting accounts, review the audit scope and confirm you own the site or have permission to test it. The free one-time audit inspects public tracking and presents findings for your assessment. Using the audit remains subject to these terms, including authorization, acceptable use and the limits of its findings.

Run the audit when you are ready to inspect an authorized site.

No card required. Read-only, your data stays yours.
